Agreement to Terms

These Terms of Service ("Terms") govern your use of thebayride.com (the "Site") and your participation in The Bay Ride, a charity cycling event produced by LiveTheBay.org, a 501(c)(3) non-profit (EIN 47-2961795). By using the Site or registering for the event, you agree to be bound by these Terms.

Use of the Site

You may use the Site for lawful purposes only. You agree not to:

• Use the Site in any way that violates applicable law or regulation
• Attempt to gain unauthorized access to any part of the Site or its systems
• Interfere with or disrupt the Site, its servers, or connected networks
• Use automated scripts to scrape, harvest, or collect data from the Site without permission
• Impersonate another person or misrepresent your affiliation with any person or entity

Event Registration

Registration for The Bay Ride is subject to availability and the terms presented at the time of registration. By registering, you represent that the information you provide is accurate and that you are physically fit to participate in a long-distance cycling event. Registration fees support cycling infrastructure and safe-streets programs funded by LiveTheBay.org.

Registration is generally non-refundable and non-transferable unless otherwise stated at the time of registration or required by law. The event may be modified, postponed, or cancelled due to weather, public safety, or other circumstances beyond our control.

Assumption of Risk and Release

Cycling is an inherently risky activity. By participating in The Bay Ride, you acknowledge and accept all risks associated with the event, including but not limited to traffic, road conditions, weather, mechanical failure, and physical exertion. You agree to ride safely, obey all traffic laws, wear a helmet at all times, and follow instructions from event staff and volunteers. You release LiveTheBay.org, its staff, volunteers, partners, and sponsors from liability for injury, loss, or damage arising from your participation, to the fullest extent permitted by law.

Media and Likeness

Photos and video are captured at The Bay Ride for promotional and documentary purposes. By participating, you grant LiveTheBay.org permission to use your name, likeness, and image in event recaps, social media content, fundraising materials, and related promotion, without compensation.

Intellectual Property

All content on the Site, including text, graphics, logos, photos, and software, is the property of LiveTheBay.org or its licensors and is protected by copyright and trademark law. You may not copy, reproduce, or redistribute any content from the Site without prior written permission.

Third-Party Services

The Site integrates with third-party services, including payment processors, registration providers, analytics tools, and social media platforms. Your use of those services is governed by the terms and privacy policies of those third parties. We are not responsible for the practices of any third-party service.

Disclaimer of Warranties

The Site is provided on an "as is" and "as available" basis. LiveTheBay.orgmakes no warranties, express or implied, regarding the Site, its content, or the event, including but not limited to fitness for a particular purpose, accuracy, or uninterrupted availability.

Limitation of Liability

To the fullest extent permitted by law, LiveTheBay.org and its staff, volunteers, partners, and sponsors will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or participation in The Bay Ride.

Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles. Any disputes arising from these Terms or your use of the Site will be resolved in the state or federal courts located in San Francisco County, California.

Changes to These Terms

We may update these Terms from time to time. Changes take effect when posted to this page with an updated "Last updated" date. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
